By accessing, browsing, registering for, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by all documents incorporated by reference, including our Privacy Policy and Disclaimer. These Terms apply to every visitor, user, and subscriber of the Service.

You represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater) and that you have the full right, power, and authority to enter into and comply with these Terms. The Service is not directed to, and may not be used by, anyone under that age.

If you use the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case “you” and “your” refer to that entity. You further represent that your use of the Service does not violate any law, regulation, sanction, or third-party right applicable to you.

Obelion Terminal is an informational and educational tool only. Obelion Inc. is NOT a registered broker-dealer, investment adviser, financial advisor, commodity trading advisor, or broker, and is not registered with or licensed by the U.S. Securities and Exchange Commission, the Financial Industry Regulatory Authority, the Commodity Futures Trading Commission, or any comparable regulatory authority in any jurisdiction.

Nothing contained in, displayed by, generated by, or made available through the Service constitutes investment, financial, legal, tax, accounting, or trading advice, a recommendation, an endorsement, or a solicitation or offer to buy, sell, hold, or otherwise transact in any security, option, derivative, cryptocurrency, or other financial instrument. All data, analytics, indicators, charts, signals, scores, and commentary are provided for general informational purposes only and do not take into account your individual objectives, financial situation, risk tolerance, or particular needs.

Your use of the Service does not create any fiduciary, advisory, agency, or professional-client relationship between you and Obelion Inc. or any of its owner, officers, employees, or contractors. You should consult your own licensed financial advisor, attorney, accountant, or other qualified professional before making any financial or investment decision. Subject to your continued compliance with these Terms, Obelion Inc.grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your own personal or internal business purposes. We reserve all rights not expressly granted to you. Obelion Inc. and its licensors retain all right, title, and interest in and to the Service, including all software, data compilations, analytics, designs, trademarks, and other intellectual property.

You agree that you will not, and will not permit any third party or automated process to:

• scrape, crawl, harvest, data-mine, or use any robot, spider, or other automated means to access, extract, or index the Service or its data except as expressly authorized in writing by us;
• resell, redistribute, sublicense, lease, rent, publish, broadcast, or otherwise commercially exploit the Service or any data, quotes, analytics, or content obtained through it;
• reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or underlying ideas of any part of the Service;
• circumvent, disable, or interfere with any usage limit, rate limit, paywall, authentication, security, or access-control mechanism;
• use the Service to engage in market manipulation, insider trading, or any deceptive, fraudulent, or unlawful activity, or in violation of any applicable securities, financial, sanctions, or other law or regulation;
• transmit malware, conduct denial-of-service attacks, impose an unreasonable load on our infrastructure, or otherwise disrupt the integrity or performance of the Service;
• share, sell, or transfer your account credentials, or allow any other person to access the Service through your account.

We may, in our sole discretion, monitor use of the Service and suspend or terminate access for any actual or suspected violation of this Section.

To access certain features you may be required to create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are solely responsible for safeguarding your login credentials and for all activity that occurs under your account, whether or not authorized by you.

You agree to notify us immediately at the address in Section 16 of any unauthorized use of your account or any other suspected breach of security. Obelion Inc. is not liable for any loss or damage arising from your failure to protect your credentials or from unauthorized access to your account. We may refuse, suspend, or terminate accounts at our discretion in accordance with these Terms.

Certain features of the Service are offered on a paid subscription basis. Paid subscriptions are billed through our third-party payment processor, Stripe, and your use of that processor is subject to its own terms and privacy practices. By subscribing, you authorize us and our processor to charge your designated payment method for the applicable fees, plus any taxes.

Subscriptions automatically renew at the end of each billing period at the then-current rate until you cancel. You may cancel at any time; cancellation takes effect at the end of the current billing period, and you will retain access until then. It is your responsibility to cancel before a renewal date to avoid being charged for the next period.

Except where a non-waivable right to a refund is required by applicable law, all fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused time, downgrades, or digital subscription access already made available to you. We may change subscription pricing, features, or tiers; we will provide notice of material price changes, and any change will take effect at your next renewal. Your continued use after a price change takes effect constitutes acceptance of the new pricing.

The Service displays market data including, without limitation, quotes, prices, gamma exposure (GEX) and other options analytics, options chains, fundamentals, news, and derived indicators. Much of this data is sourced from third-party providers and exchanges over which we have no control.

All market data is provided “AS IS” and may be delayed, inaccurate, incomplete, out of sequence, interrupted, or unavailable. Quotes and analytics are not guaranteed to be real-time, accurate, or suitable for any purpose. Obelion Inc. and its data suppliers disclaim all liability for any errors, omissions, delays, interruptions, or inaccuracies in the data, and for any downtime or loss of access, and shall not be liable for any decision made or action taken in reliance on such data.

You must not use the Service or any data it provides as the sole basis for any investment, trading, or financial decision. Verify all data independently against authoritative sources before acting.

Trading and investing in securities, options, derivatives, and other financial instruments involve substantial risk of loss and are not suitable for every person. Markets are volatile and unpredictable. By using the Service you expressly acknowledge and accept these risks.

You may lose some or all of your invested capital, and you could lose more than your initial investment when using leverage, margin, or derivatives. Past performance, hypothetical results, and historical data do not guarantee or indicate future results. You alone are responsible for evaluating the merits and risks of any decision, for all decisions you make, and for any and all resulting gains or losses. Obelion Inc. bears no responsibility for your trading or investment outcomes.

THE SERVICE, INCLUDING ALL DATA, CONTENT, ANALYTICS, AND FUNCTIONALITY, IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Obelion Inc. AND ITS OWNER, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, QUIET ENJOYMENT, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA, RESULT, OR OUTPUT WILL BE ACCURATE OR RELIABLE. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you; in that case, such warranties are limited to the minimum scope and duration permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Obelion Inc. OR ITS OWNER, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR USE, OR FOR ANY TRADING OR INVESTMENT LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF Obelion Inc. AND ITS PERSONNEL FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU ACTUALLY PAID TO Obelion Inc. FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

The limitations and exclusions in this Section apply to the fullest extent permitted by law and form an essential basis of the bargain between you and Obelion Inc.. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you; in that case, our liability is limited to the minimum extent permitted by law.

You agree to indemnify, defend, and hold harmless Obelion Inc. and its owner, officers, directors, employees, contractors, agents, licensors, and suppliers (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, proceedings, liabilities, damages, losses, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• your access to or use of, or inability to use, the Service;
• any content, data, or information you submit, post, or transmit through the Service;
• your violation of these Terms or of any applicable law, regulation, or third-party right (including any intellectual property, privacy, or contractual right);
• any financial, trading, or investment decision you make in connection with the Service.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses. This obligation survives termination of these Terms.

The Service may contain links to, or integrate with, third-party websites, data providers, payment processors, and other services that are not owned or controlled by Obelion Inc.. We do not endorse and are not responsible or liable for the content, accuracy, availability, products, services, practices, or policies of any third party. Your dealings with, and use of, any third-party service are solely between you and that third party and are governed by that third party’s own terms. We encourage you to review those terms before using any third-party service.

We may suspend, restrict, or terminate your access to all or part of the Service at any time, with or without cause and with or without notice, in our sole discretion, including if we believe you have violated these Terms or that your use poses a risk to Obelion Inc., other users, or any third party. You may stop using the Service at any time.

Upon termination, your license to use the Service immediately ends. Any provisions that by their nature should survive termination — including, without limitation, the disclaimers in Sections 02, 06, 07, and 08, the limitation of liability in Section 09, the indemnification in Section 10, and the governing-law and dispute provisions in Section 14 — survive termination of these Terms.

We may modify these Terms from time to time to reflect changes in the Service, our practices, or applicable law. When we make material changes, we will post the revised Terms on this page and update the “Last updated” date above. Where required by law, we may provide additional notice.

Your continued access to or use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

These Terms and any dispute arising out of or relating to them or the Service are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules.

To the fullest extent permitted by applicable law, you and Obelion Inc.agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively by final and binding individual arbitration, rather than in court, except that either party may seek relief in small-claims court for qualifying claims, or seek injunctive or equitable relief to protect its intellectual property or confidential information.

YOU AND Obelion Inc. EACH WAIVE ANY RIGHT TO A TRIAL BY JURY AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. All disputes shall be brought solely in your or our individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Arbitration shall be conducted on an individual basis, and the arbitrator may not consolidate more than one person’s claims.

Where binding arbitration or the class-action waiver is not enforceable under the law applicable to you, you and Obelion Inc. agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States, for the resolution of such disputes, and the remaining provisions of this Section continue to apply to the maximum extent permitted by law. This Section reflects the parties’ intent that disputes be resolved individually; local law may limit or modify its application.

Entire agreement. These Terms, together with the Privacy Policy, the Disclaimer, and any other terms incorporated by reference, constitute the entire agreement between you and Obelion Inc. regarding the Service and supersede all prior or contemporaneous agreements, understandings, and communications.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Obelion Inc..

Assignment. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent, and any attempted assignment in violation of this provision is void. Obelion Inc. may freely assign or transfer these Terms, in whole or in part, without restriction or notice.

Force majeure. Obelion Inc. is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, exchange or data-provider outages, telecommunications or internet failures, power outages, or other force-majeure events.
